Facing redundancy? Know your rights.
If an individual receives a redundancy offer from an NHS employer, it is their responsibility to check any monetary value and terms within that offer against their contract of employment and the Agenda for Change handbook. There is no need for legal input at this point as redundancy is a normal dismissal process and one of the legally fair reasons for dismissal. However, Unison will support our members to pursue a legal claim, (as a breach of contract), where the amounts of any redundancy offer are clearly incorrect or where the redundancy is being claimed as an unfair dismissal. However these claims can only be made after the dismissal has happened and you should then contact your local rep for help.
It should be noted that Unison cannot advise members as to whether or not the content of the redundancy offer is correct or whether or not they should be accepting the offer.
